White Officer Accuses City Of Discrimination In Lawsuit

CLEVELAND -- A white police officer who shot and wounded a 12-year-old black boy is accusing Cleveland and its police department of racial discrimination against him in a federal lawsuit.

The trial is scheduled to start Tuesday in the lawsuit filed by Patrolman Edward Lentz Jr., who says he suffered retaliation and was used as a scapegoat by officials seeking to appease black community leaders and politicians who were upset over the shooting of a black youth.

Lentz argues that during a drawn-out investigation of the shooting, he was given degrading duty, denied opportunities to earn overtime pay and informally punished in other ways. He says the treatment was harsher than that of black officers who shot other black people.

The city's lawyers said Lentz's complaints are "based upon innuendo, coincidence and shadowy conspiracy theories that have no basis in reality."

They said the investigation took longer than expected because the department had six fatal shootings involving officers within eight months of the one involving Lentz, and those investigations took precedence.

"His entire case is based upon speculation that he was made a sacrificial lamb to appease public outcry," city Assistant Law Directors Kevin Gibbons and Ami Patel wrote in court documents, "yet he presents no evidence that there was a public outcry, nor any evidence to show how his treatment was designed to appease them."

The shooting happened Dec. 6, 2001, while Lentz was providing security outside the home of Jane Campbell, who had recently been elected mayor.

In his lawsuit, Lentz says he shot Lorenzo Locklear through the roof of a station wagon that had sped toward him as he approached it on foot, dragging him before he was able to get on top of the vehicle and fire 14 shots. He says he had ordered the driver of the car to stop. Locklear was wounded in his arm, hip and ankle.

A grand jury in 2003 rejected a felonious assault charge against Lentz. Locklear was found delinquent in juvenile court in 2003 for driving the stolen car and possessing marijuana.

Lentz' lawsuit is similar to one filed last August by two detectives involved in the fatal 2005 shooting of 15-year-old Brandon McCloud. Detectives Philip Habeeb and John Kraynik seek $2 million, claiming they were inappropriately punished for a justified shooting because they are white and McCloud was black.

In his lawsuit, Lentz says the city also violated his privacy by releasing confidential psychological records from his personnel file to the news media, and that the city retaliated when he pursued federal sanctions against the city for releasing the records.

On the January 15 edition of his nationally syndicated radio show, in a monologue about Martin Luther King Day, Michael Savage called "civil rights" a "con" and asserted: "It's a racket that is used to exploit primarily heterosexual, Christian, white males' birthright and steal from them what is their birthright and give it to people who didn't qualify for it." Savage then said, "Take a guess out of whose hide all of these rights are coming. ... [T]here is only one group that is targeted, and that group are white, heterosexual males." He added: "They are the new witches being hunted by the illiberal left using the guise of civil rights and fairness to women and whatnot."

I think this is a pretty clear-cut case of a white police officer getting pissed off and pulling the OMGRACISTS bit because he doesn't like standard investigative procedure.

I really don't understand your whole "owning ones blackness" bit, Gordon. This isn't being investigated solely because of race. There are always investigations when police officers shoot civilians, especially when they are children.

And if there was a backlash against him within the black community, it is not uncalled-for. To say that it is would be to deny that the black community has had their children unnecessary shot/beaten/killed by white officers before. They're justified in being on edge about such incidences.

You could probably tell that half my answers were meant to be joking around.
On the other hand, if black folks wanna get mad (assuming there is indeed a 'backlash' going on--which seems debatable) then race should be less of an issue that cops shooting people in general.

And yeah, I know the kid was 12 years old, but if someone was dragging me with a car I'd shoot 'em too.

Oh, yeah, the whole "owning ones blackness" was a joke. A'la Chris Rock, for example, can say the word "nigger" because he's black and thus "owns his blackness". Extending this concept I was saying that if this guys story is true about him being scrutinized more closely that black officers who shoot black people then he should understand that it's OK for a black cop to shoot black people because it's a black thing.

It was a joke.

I think this cop is probably a joker. One thing, though, how old is he? If he's close to retirement then being held back from promotions etc will effect his pension and I can see him getting upset about that.
Cops are working class, after all.

Widow Sues After Officer Killed Responding To Call For Help
Wrongful Death Claim Goes Before Court Monday

MASSILLON, Ohio -- A police officer killed while responding to a call for help from the State Highway Patrol should have been told the man they were pursuing was likely armed and dangerous, the officer's widow says in a wrongful death claim against the state.

JuWanna E. Taylor, whose case goes before the Ohio Court of Claims on Monday, is suing the Ohio Department of Public Safety and the patrol.

Her husband, Eric B. Taylor, was killed during the chase of Donald Matthews on Aug. 9, 2002. The patrol failed to tell dispatchers that Matthews was likely armed and acting in a dangerous and threatening way toward a state trooper, the claim says.

The state maintains that Trooper Joseph Hershey and patrol dispatchers followed protocols in place then, Attorney General Marc Dann said Saturday.

"This is a case where it's a tragic situation," Dann said. "We have an expert that says they followed proper procedure, the plaintiffs have an expert that says the opposite, and the judge is going to decide."

Matthews fatally shot Taylor and also was killed in the shootout.

The claim alleges that Hershey, who made the call acting for backup after Matthews wouldn't cooperate in a traffic stop, acted recklessly and that his actions directly led to Taylor's death.

According to reports, Hershey spotted Matthews speeding south on Ohio 21. Matthews pulled over but rolled down both his passenger and drivers side windows only an inch and refused to give the trooper his license.

Hershey stopped Matthews three times before the chase ended where Taylor was killed in a construction lot in Massillon, 50 miles south of Cleveland, the reports said.

In response to the shooting, the state began developing a warning system for when police encounter someone who has threatened to harm law enforcement officers previously.

However, the patrol said the alert likely wouldn't have worked in this case because Matthews was driving a car registered to his wife.

CLEVELAND -- A federal jury Friday ruled in favor of a white Cleveland police officer in his racial discrimination lawsuit against the police department.

Officer Edward Lentz Jr. alleged that he was unfairly used as a scapegoat after he shot and wounded a 12-year-old black boy.

He said he received degrading duties, was denied opportunities for overtime and was treated more harshly after the shooting than a black officer would have been.

Lentz was awarded $800,000 in the lawsuit.

City attorneys denied Lentz's accusations and the city said it plans to appeal the decision.

Police officer wins discrimination suit

A federal-court jury awarded $800,000 to a white Cleveland police officer this afternoon after finding the city racially discriminated against him after he shot a black youth.

Patrolman Edward Lentz Jr. won the verdict five years after he shot a 12-year-old boy to end a confrontation that began outside then Mayor-elect Jane Campbell's Shaker Square home.

During the ensuing city investigation, Lentz's bosses yanked him from patrol duty and confined him to the police gymnasium for 652 days. That miserable detail, Lentz claimed in U.S. District Court, lasted far longer than any did for a black officer involved in a shooting, and was clearly a punishment.

The jury also found the city retaliated against Lentz by filing disciplinary charges when he complained during his protracted gym detail to the federal Equal Employment Opportunity Commission.

Lentz tearfully hugged family members and other supporters after the jury filed out of Judge Kathleen O'Malley's courtroom. He said he would comment on the ruling later today.

Assistant City Law Director Kevin Gibbons declined to comment afterward, referring a reporter to Law Director Robert Triozzi.

If the verdict withstands appeal, the city would be paying both parties to the incident. The wounded juvenile, Lorenzo Locklear, won a substantial but undisclosed settlement after he sued the city.

The incident that sparked the case occurred Dec. 6, 2001. Lentz was on guard detail in a patrol car parked outside Campbell's house about three weeks after her election victory. A station wagon careened around a corner, then screeched to a stop behind Lentz, nearly ramming his cruiser.

Somehow - exactly how this happened has been hotly disputed - Lentz wound up atop the car as it sped away. When the driver refused to stop, Lentz shot through the roof 14 times, bringing the car to a halt. The shooting wounded Lorenzo in the arm, hip and ankle.

Teen Car Theft Suspect Shot By Police

SHAKER HEIGHTS, Ohio -- A teen suspected in a car theft was shot by police Wednesday afternoon in Shaker Heights.

Authorities said police stopped a green Ford Contour that was a suspected stolen vehicle following a chase and a crash. The incident took place on Fairhill Road, just east of the water treatment facility near the Cleveland border.

POlice said three teens were in the car, a 15-year-old, a 16-year-old, and a 17-year-old.

One of the officers opened fire on the juvenile suspects, hitting the 15-year-old in the shoulder. He is being treated at Rainbow Babies and Children's Hospital and is listed in satisfactory condition.

The two other teens are now under arrest.

The officer involved in the shooting has been placed on administrative leave while the incident is investigated.

The officer is a 25-year veteran with an outstanding record, police said.

Grand Jury Won't Charge Officers In Teen's Shooting Death

CLEVELAND -- A Cuyahoga County grand jury Wednesday declined to indict two Cleveland police officers who fatally shot a 15-year-old boy.

The jurors ruled that detectives Phillip Habeeb and John Kraynik did not break the law in shooting and killing Brandon McCloud while searching his house for evidence of a robbery in September 2005.

This is the second time the officers have been cleared of wrongdoing. Special prosecutor C. Ellen Connelly ruled last June that the shooting was not a crime, though she declined to call the shooting justified.

Family Upset

AKRON, Ohio -- An Akron police officer shot and killed a teenager during a traffic stop Saturday morning, officials said.

Demetrus R. Vincent, 19, of Akron, was killed at about 3 a.m. in the driveway of his home on Victoria Avenue.

Police said officers approached the car, then Vincent grabbed a gun and pointed it at them. One of the officers then fired at Vincent, killing him.

"The passenger officer could see the guy reaching between the seat. At that point, he pulled up the gun and started to turn on the officer. That's when he warned the other officer that they had a gun," Lt. Rick Edwards said.

Police said they followed Vincent after spotting him leaving a known drug house in the neighborhood.

The family said a 15-year-old in the passenger seat of the car was telling a different story about the gun in the car.

"The witness in the car said he didn't pull a gun," Vincent's uncle, Horace, said.

The shooting is under investigation. The officers involved are four- and seven-year veterans. They were placed on administrative leave

Officer Fatally Shoots Teen On City's East Side

CLEVELAND -- A shooting involving an off-duty police officer left a 17-year-old dead early Friday morning.

The officer was working security at the apartment complex at East 79th Street when he allegedly shot and killed Angelo Miller, officials said.

Officials said the off-duty police officer was called to the scene amid suspicion that people were breaking into cars at the Lexington Village apartment complex on the city's east side.

Witnesses told NewsChannel5 that Miller attempted to run over the police officer.

The officer has worked at Lexington Village for more than a decade. He also lives in the community.

Lt. Thomas Stacho said the officer investigated and recovered some property apparently taken from vehicles in the parking lot. The officer also noticed some smashed car windows and stereos missing.

He took the recovered property to the complex office, then went back to the scene to investigate further. The officer had a confrontation with Angelo Miller and noticed several car stereos in the back seat around 1:45 a.m. and fired shots. The car then crashed.

Miller's family members do not believe the story.

"He's afraid of the police," said his brother, Dante Kirkman. "If the police come, he's gonna get on his knees and lay down."

Miller has two children. Both of them are 1-year-old.

The officer's name has not been released but he has been placed on administrative leave pending an investigation of the shooting.

Officer Accused Of Using Stun Gun Reinstated

LORAIN, Ohio -- The city and its police department must take back an officer fired last fall amid accusations that he had used a stun gun on a handcuffed prisoner, an arbitrator ruled Monday.

The reinstatement of Patrolman Daniel Bozsoki was to be immediate and with full seniority, though he would not receive any back pay and could be fired again for breaking any department rule, according to the decision from arbitrator James Mancini.

Bozsoki, a second-year officer, was dismissed October 10 after internal investigators concluded that he violated department rules, including using unnecessary violence and inhumane treatment toward a prisoner.

At that time, Police Chief Cel Rivera said Bozsoki acknowledged that he used his Taser to stun Kalian Santiago on May 1 to show that "he meant business."

Investigators concluded that Santiago, 24, of Lorain had done nothing to deserve being shocked. Santiago was handcuffed in the back seat of a cruiser when he was stunned, the report said.

The Fraternal Order of Police appealed Bozsoki's dismissal to the arbitrator.

"The evidence demonstrates that Bozsoki engaged in serious misconduct. But he wanted only to intimidate Santiago and did not intend to shock or harm him," Mancini wrote. The arbitrator noted that the officer had had a clean work record and concluded that Bozsoki's firing was too severe a punishment.

Mike Kobylka, the city's safety service director, disagreed and said Monday he was disappointed with the ruling. He also said Bozsoki was expected to return to work within days. The officer can be rehabilitated with the second chance he's being given, said Robert Phillips, an attorney for the police union.

Rivera, the police chief, said he wasn't surprised by the reinstatement ruling and said he hoped Bozsoki had learned from the experience.

"It's something we have to live with," Rivera said.

Police: Suspect Shot By Officer On West Side

CLEVELAND -- Cleveland police are at the scene of a fatal officer-involved shooting that took place on the city's west side Tuesday afternoon, police confirmed.

The incident happened at near the intersection of West 82nd Street and Denison when officers pulled over a gray Suburban on a routine traffic stop.

Witnesses said they heard shoults of "Get out, get out" amd then heard four shots fired.

The suspect was shot during the confrontation with police. The officer involved was not injured.

The coroner confirmed that the suspect was killed in the shooting.

The suspect's girlfriend told NewsChannel5 that the 23-year-old man worked for RTA and was doing nothing wrong when police shot him.

Police are expected to give a briefing on the incident sometime Tuesday evening.
